POOR DENIED MEDICAL TREATMENT - All India Institute of Medical Sciences (AIIMS), a premier Government Health Institution has asked very poor parent of a 7 years old critical patient of Cardiology to deposit a sum of Rs.25,000/- with the hospital as a part of medical treatment expenses. The hospital has earlier told him that he had to pay to the extent of Rs.80,000/- for medical treatment of his son. The operation date has been given as 30.05.2011. The poor fellow resides at Hathras (U.P.) and works as daily rated labourer. He belongs to SC category. His average monthly income is even less than Rs.2000/-. He has to borrow money from the relative etc. even for meeting the travel expenses. He is unable to pay any money to the hospital. He has been approaching the hospital management for providing him totally free treatment but no one takes note of him. In this backdrop, he has approached me. A writ petition under Article 226 of the Constitution of India is being filed in Delhi High Court tomorrow which is expected to come up for hearing on 26.05.2011. It has been contended in the petition that Article 21 (right to life) of the Constitution has been violated. State has a constitutional obligation to ensure that no person is deprived of medical care and treatment merely because he cannot afford to pay.
